Terms & Conditions

These General Terms and Conditions (“Terms”) govern the relationship between Cape Adieu Harbour Cruises (“we,” “us,” “our”) and all guests and users (“you,” “your”) who book, participate in, or engage with our services, including cruises, charters, safaris, events, and related activities. By making a booking or using our services, you agree to these Terms.

1. Bookings and Payment
All bookings are subject to availability and confirmed upon receipt of full payment.
Payment can be made via our website, by phone, or in person.
Prices listed are in Australian Dollars (AUD) and include applicable taxes unless stated otherwise.
We reserve the right to update pricing and availability at any time without notice, except for confirmed bookings.


2. Cancellation and Refunds
Guest Cancellations:
Cancellations made more than 7 days before the cruise date are eligible for a full refund.
Cancellations made within 7 days of the cruise date are non-refundable, unless due to extenuating circumstances, which will be reviewed on a case-by-case basis.
Cape Adieu Cancellations:
In the rare event that we need to cancel a cruise (e.g., due to weather conditions or operational reasons), guests will receive a full refund or be offered the option to reschedule.

 

3. Departure and Check-In
Cape Adieu departs from the far end of Stokes Hill Wharf (behind Crustaceans restaurant).
Check-in commences at 5:00pm. Please ensure you are at the departure gate at this time, as we are unable to guarantee seating requests or wait for late arrivals.

 

4. Health, Safety, and Conduct
All guests must comply with health and safety instructions provided by our crew during the cruise.
We reserve the right to refuse service or remove any guest from the vessel if their behaviour poses a risk to themselves, others, or the vessel, or if they are disruptive to the experience of others.
We are not liable for any injuries, loss, or damage that occur as a result of non-compliance with safety instructions or reckless behaviour.

 

5. Weather and Conditions
Cape Adieu operates in a tropical climate, and cruises will generally proceed in light rain or moderate weather conditions.
In the event of severe weather, we may need to cancel or reschedule the cruise for safety reasons. Guests will be notified as soon as possible, and a full refund or rescheduling option will be provided.
We recommend that guests dress appropriately for tropical conditions and bring sun protection and wet-weather gear if needed.

 

6. Dietary Requirements
We make every effort to accommodate dietary requirements if notified at the time of booking. Please inform us of any specific needs in advance.
While we aim to cater to all guests, we cannot guarantee that meals will be free from allergens such as nuts, gluten, or dairy.

 

7. Liability
Cape Adieu Harbour Cruises takes all reasonable measures to ensure the safety and well-being of guests. However, by participating in our cruises, you acknowledge that there are inherent risks associated with being on the water.
We are not liable for any personal injury, loss, or damage to personal property unless caused by our negligence or failure to provide services with due care and skill.
Guests are responsible for their own personal belongings, and we recommend that valuable items are kept safe during the cruise.

 

8. Children
Children are welcome aboard Cape Adieu cruises, but they must be supervised by a responsible adult at all times. For safety reasons, children must remain seated and follow all crew instructions while on board.

 

9. Alcohol and BYO
Cape Adieu is a licensed venue, and guests are welcome to purchase drinks from our onboard selection.
BYO (Bring Your Own) alcohol is not permitted.
Responsible drinking is required at all times. Any guest displaying excessive intoxication or inappropriate behaviour may be asked to leave the cruise without a refund.

 

10. Photography and Media
We encourage guests to take photos during their cruise; however, please be mindful of the comfort and privacy of other guests.
By participating in our cruises, you consent to being photographed or filmed for promotional purposes. If you do not wish to appear in any marketing materials, please notify us in advance.

 

11. Changes to Services
We reserve the right to make changes to our cruise schedule, itineraries, or services where necessary. Guests will be informed of any significant changes as soon as possible.

 

12. Privacy and Data Protection

13. Force Majeure
Cape Adieu Harbour Cruises is not liable for any failure or delay in performing its obligations due to events beyond our reasonable control, including but not limited to weather events, acts of nature, fire, flood, or government restrictions.
